PA installed a new individual computer management system with the goal of better and more efficient communication with taxpayers. The goal from direct discussions with employees of Pennsylvania is to get individual PA EITC tax credits processed faster and with less manual processes so refunds can go out without significant delays.
My Path first tax notice
The first notice came out of My Path asking for proof of your PA EITC tax credit to be mailed. This request came because DCED (Department of Community and Economic Development) did not send the PA Department of Revenue a master list of PA EITC tax credit prior to June 2021. If you uploaded or mailed or faxed or emailed your K-1 packet received in February 2021 from our charity that would have created a "please process this refund" prompt to the employees at the PA Department of Revenue. If you did nothing the employees at the Department of Revenue still should attempt to process your refund in 60 to 90 days from this notice when the master list arrived from the DCED.
My Path Second tax notice threatening an Assessment
Recently this second notice was generated from the PA Department of Revenue My Path computer system. Once again the notice says they do not have proof of your PA EITC tax credit even though every SPE has proof of filing the 1123's and all K-1's have been filed in February. This notice was generated because the tax credits from DCED had not been properly inputted into My Path by the time this second notice was generated. Once again we have been assured this will not happen next year.
Here is a direct quote for a Pennsylvania Department of Revenue employee as of August 24, 2021 on how to handle this second My Path tax notice.
"We are working on something official but taxpayers should follow the instructions on the My Path tax notice.
Go to Mypath.pa.gov
Go to Submissions panel (last one on page) and pick Respond to a letter link
Enter letter ID number and your ID number
Request that "Please check the state database and apply the EITC credit requested".
This action will stop the denial of the credit until state employees can work the request you submitted. If the process asks for an upload of proof we suggest our K-1 packet and page 1 and 2 of your PA 40 and your Form OC from your 2020 tax filing.
Refunds for EITC are being processed by Pennsylvania now and many have gotten their 2020 tax refunds so the process is working faster. We feel confident that for 2021 DCED and PA Dept of Revenue have created a process that will issue refunds faster and hopefully avoid all tax notices.

In the past you can get a direct response from the state on the status of your PA refund by using the "submit a question" tab at this state website. You will need to create a username and password to access this feature. A Pennsylvania Department of Revenue employee will give you a response to your question in less than 2 days by email and typically assign your tax return for refund processing putting you to the "top of the list".
